Accu-Chek "Click 4 Cash in 2010" Contest
Rules and Regulations
1. Contest Sponsor: The Accu-Chek "Click 4 Cash in 2010" Contest (the "contest") is operated and sponsored by Roche Diagnostics (Canada) (the "draw Sponsor").
2. Entries: Defined as: Canadian residents who have reached the age of majority in their province or territory of residence.
3. Participation: No purchase is necessary. To be eligible to win, participants must enter the contest by visiting the Accu-Chek "Click 4 Cash in 2010" contest page and signing up as Registered (returning users) or Registering (new users) participants from March 2nd, 2010 to December 31, 2010 (the contest period). Limit of one (1) entry per person per month.
For each new entry (excludes repeat monthly entries) received, the draw Sponsor will make a one dollar ($1.00) CAD donation towards diabetes research. The total amount donated will be divided equally among the following organizations:
− Canadian Diabetes Association
− Juvenile Diabetes Research Foundation
− Diabète Québec
− The Diabetic Children’s Foundation
4. Prizes:
Monthly Prizes:
- Throughout the contest period, there will be a monthly draw for a one thousand dollar ($1,000) CAD cash prize.
Grand Prize:
- One (1) Grand Prize will be awarded at the end of the contest period. The winner will win a five thousand dollar ($5,000) CAD cash prize.
The total value of prizes awarded is $14,000.
Draw:
- At 4:00 pm (ET), on the first open day of each month, at Roche Diagnostics, 201 boul. Armand-Frappier, Laval, Quebec H7V 4A2, a random draw will be performed from among all the entries submitted during the previous month in order to award the Monthly Prize.
- At 4:00 pm (ET), January 10, 2011 at Roche Diagnostics, 201 boul. Armand-Frappier, Laval, Quebec H7V 4A2, a random draw will be performed from among all the entries submitted during the contest period in order to award the Grand Prize.
- Limit of one prize per person per household. In the event that en entrant would be found ineligible prior to his/her prize being awarded, such entrant would be disqualified and another random selection would be performed up until such a time as a new entrant would be selected and declared a winner.
5. Acceptance of Prizes: In order to be declared a winner, each selected entrant shall:
- Monthly Prizes: have correctly answered the mathematical skill-testing question featured on the Receipt, Release and Discharge Form. The winner will be contacted by email within 2 working days of the draw.
- Grand Prize: have correctly answered the mathematical skill-testing question featured on the Receipt, Release and Discharge Form. The winner will be contacted by email within 15 working days of the draw.
- Monthly/Grand Prize: Sign the release and liability waiver declaration form that will be sent to him/her by mail, and return it to the “draw Sponsor” with 15 days of its receipt.
- Failure to comply with any of the conditions set forth in these rules will result in the entrant being disqualified.
- The “draw Sponsor” will send their prize by mail to the Monthly and Grand Prize winners within 4 to 8 weeks of the draw.
- Entries are subject to verification by the “draw Sponsor”. Any entry found to be illegible, incomplete, altered, fraudulent, forged or mechanically reproduced, delayed or which does not feature the correct response to the mathematical skill-testing question will automatically be declared void and will not entitle the entrant to any prize. All of the “draw Sponsor”' decisions regarding the application of the provisions of this Paragraph are final.
- Prizes must be accepted as described in these rules and may not be transferred to another person or substituted for another prize, in part or as a whole, subject to the provisions set forth in the paragraph below.
- In the event that, for reasons out of their control and unrelated to the winners, the “draw Sponsor” were unable to award the Monthly/Grand Prizes as described in these rules and regulations, they agree to substitute a prize of equivalent value.
- Subject to the approval of the Régie des alcools, des courses et des jeux du Québec, the “draw Sponsor” reserves the right, at its complete discretion, to modify, to cancel, terminate or suspend this contest or any part of it should a virus, computer bug, unauthorized human intervention and/or any other factor which cannot be controlled by the “draw Sponsor” and which may corrupt or affect the management, security, neutrality or normal process of the contest affect the outcome of the contest.
- All entries become the property of Roche Diagnostics and none of them will be returned to the entrants at any time. No correspondence or communications concerning this contest will be exchanged with the entrants, except with entrants eligible to win a prize.
- Residents of Québec: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie, only for the purpose of helping the parties reach a fair settlement.
- For the purpose of these rules, the entrant is the person whose name appears on the entry. Should the given entry be eligible to win the prize, only such person shall be awarded a prize.
- Should discrepancies exist between the French and English versions of these rules, the English version prevails.
6. Chances of Winning: Odds that a given entry be selected at random depend on the number of eligible entries submitted during the contest period.
7. Contest Closing Date: Entries will be accepted no later than December 31, 2010.
8. Notification of Winners: Within a few days of the Monthly and Grand Prize draws, the “draw Sponsor” will send an email and a release and liability waiver declaration form to the selected entrants for a Grand Prize via recommended mail to instruct them as to the manner in which they may claim their prize.
9. Publicity: By entering the contest, the winner authorizes the use of his or her name and/or likeness, city of residence in any publicity related to the draw carried out by the “draw Sponsor” without compensation, in Canada/US, in any and all forms of media, now known or hereafter devised, including the Internet, unless prohibited by law. The winners may be published on www.accu-chek.ca
10. Limitation of Liability and Indemnity. By entering the contest entrants agree to release (except as set forth below), indemnify and hold harmless the contest Sponsor, the Prize Sponsors, any of their respective parents, affiliates and subsidiaries, advertising, promotional, publicity, production and judging agencies, directors, officers, employees and agents from any claim, loss, expense (including legal fees) or other liability, including liability for personal injury, arising from participation in the contest or the awarding, acceptance, use or misuse of any of the prizes.
11. Roche Diagnostics employee(s), a representative or agent, and the persons with whom they are domiciled may not enter the contest.
